Terms of Service
Last updated: September 29, 2026
These Terms of Service ("Terms") govern your access to and use of www.tankerflow.com and the related Tankerflow products, applications, emails, messages, and services (collectively, the "Services"). The Services are operated by Tankerflow, LLC ("Tankerflow," "we," "us," or "our").
By accessing or using the Services, or by clicking to accept these Terms, you agree to these Terms on behalf of yourself and, if you use the Services for an organization, on behalf of that organization. You represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not access or use the Services.
You must be at least 18 years old to use the Services. The Services are for business use only, and you agree that you are not using them as a consumer.
Please read Section 19 carefully. It contains an arbitration agreement, class action waiver, and jury trial waiver that affect how disputes between you and Tankerflow are resolved. Unless you opt out as described in Section 19, you and Tankerflow agree to resolve covered disputes through binding individual arbitration rather than in court.
1. Our Services
Tankerflow is a software platform that connects tank-truck fleets with tank wash facilities. The Services may include tools to find wash facilities along a route, manage facility listings, book washes, pay for washes and receive payouts, receive receipts and wash certificates, and send wash documents to shippers, receivers, and others.
Tankerflow is not a wash facility, motor carrier, freight broker, freight forwarder, shipper, or certification body. We do not perform, supervise, or inspect washes, and we do not guarantee that any wash will be performed, performed on time, or performed to any standard. Any agreement for a wash is between the fleet and the wash facility. Tankerflow is not a party to that agreement, except as a limited payment collection agent as described in Section 9.
We may add, change, suspend, or remove any part of the Services at any time, with or without notice, and without liability to you. Some features may be offered as beta, preview, or limited releases. Those features are provided as-is and may change or end at any time. We have no obligation to monitor users or content, but we may do so.
2. Accounts and Organizations
To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for keeping your sign-in details confidential and for all activity through your account. You must notify us promptly at support@tankerflow.com if you believe your account has been compromised.
Accounts belong to organizations, such as fleet organizations and wash facility organizations. Each organization is responsible for all activity by its members, and its admins are responsible for managing members, roles, and access. Your organization may control your account and your access to its information. You may not access an organization's account unless that organization authorizes you.
We may approve, reject, suspend, remove, or reassign any account, organization, role, facility listing, or facility claim in our discretion.
3. License and Restrictions
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes.
You may not:
- Copy, modify, distribute, sell, lease, sublicense, resell, or commercially exploit the Services, except as these Terms expressly allow.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying ideas of the Services, except to the extent applicable law prohibits this restriction.
- Access the Services to build, benchmark, or support a competing product or service.
- Copy, scrape, or compile facility listings or other content from the Services into another database, directory, or dataset, or use them to train machine learning or artificial intelligence models.
- Use bots, scrapers, crawlers, automated agents, or similar tools to access or extract data from the Services without our prior written permission.
- Interfere with, disrupt, overload, or compromise the security, integrity, or performance of the Services.
- Bypass access controls, rate limits, authentication, or other restrictions.
- Use the Services in violation of law, third-party rights, or these Terms.
Tankerflow and its licensors own the Services, including the facility directory, its compilation, and all related software, content, and data, except for User Content that you own. All rights not expressly granted to you are reserved.
4. User Content and Data
"User Content" means information, data, text, photos, files, listings, facility details, bay details, services, prices, booking details, wash records, notes, communications, and other content that you or your organization submit to or through the Services.
You retain ownership of your User Content, subject to the rights you grant in these Terms. You represent and warrant that you have all rights and permissions needed to submit your User Content and to grant the license below.
You grant Tankerflow a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, and sublicensable license to host, store, reproduce, process, display, publish, transmit, modify, create derivative works from, and otherwise use your User Content to provide, secure, support, analyze, improve, and promote the Services, keep records that other users rely on, comply with law, enforce these Terms, and operate Tankerflow's business.
Tankerflow owns all usage data and all aggregated or de-identified data derived from the Services, and may use it for any purpose.
You are solely responsible for your User Content. We do not guarantee that User Content is accurate, complete, current, legal, or safe. We may remove, restrict, or modify User Content at any time in our discretion.
5. Facility Listings and Claims
We may create, publish, update, and remove facility listings using public information and other sources, whether or not a facility uses the Services. A listing does not mean that Tankerflow endorses, verifies, or is affiliated with a facility.
A wash facility organization may submit a claim to manage a listing. We may approve or reject a claim in our discretion and may require proof of ownership or authority. We may revoke a claim, remove a facility from an organization, transfer a listing to another organization, or resolve an ownership dispute in our discretion.
Facility organizations are responsible for the accuracy and completeness of everything on their listings, including names, addresses, hours, phone numbers, websites, certifications, bays and the container and product types each bay can take, services, and prices, and for keeping that information current. A facility may list a certification only if it currently holds it. Facility organizations are responsible for performing washes safely, professionally, and lawfully; for holding the licenses, permits, certifications, and insurance their business requires; and for complying with environmental, wastewater, health, safety, and other laws that apply to their operations.
We decide which facilities appear in search results and in what order, using factors we choose, such as whether a facility accepts online bookings and the added driving time of the detour. We may change how results are ranked at any time.
6. Online Bookings
Turning on online bookings. When a facility turns on online bookings, it commits to honor every booking placed through the Services. Availability is calculated from the facility's hours, bays, and existing bookings, so the facility must keep that information accurate.
Placing a booking. A booking is scheduled as soon as it is placed. No further approval is needed. The fleet must provide accurate booking details, including container type, product type, and load details such as prior contents and hazards, and must provide any safety data sheets or other information the facility needs. Drivers must follow the facility's site rules.
Cancelling. A fleet or a facility may cancel a booking through the Services until its time slot ends, and the other side will be notified. A facility should cancel only when it cannot perform the wash. We may restrict accounts, turn off online bookings for a facility, or take other action if a user repeatedly cancels, misses bookings, or places bookings it does not intend to use.
Our role. We may cancel, change, or restrict any booking in our discretion, including when a facility closes or an organization is removed. A booking does not guarantee that a wash will be performed, performed at the booked time, or performed as expected. Fleets and facilities are responsible for resolving disputes between them. We may help, but we have no obligation to do so.
7. Fleet and Driver Responsibilities
Fleets, dispatchers, and drivers are responsible for route and scheduling decisions, safe vehicle operation, hours-of-service and hazardous materials compliance, trailer and tank suitability, driver instructions, and the information they provide to facilities.
Drivers must not use the Services while driving in violation of law, and should use the Services only when it is safe and legal to do so.
Maps, routes, added driving time and distance, facility information, hours, availability, and prices shown in the Services may be incomplete, delayed, or inaccurate. You are responsible for independently confirming information that matters to your operations, safety, legal compliance, or schedule.
8. Fees
We may charge fees for the Services at any time, including platform fees on payments made through the Services. Fees may be charged to fleets, facilities, or both. We will show the fees that apply before you incur them. We may change our fees, or end any free offering or fee waiver, at any time. Fees are non-refundable except where these Terms or the law say otherwise.
You are responsible for all taxes, duties, and similar charges that apply to your business, services, and transactions, except to the extent Tankerflow is required to collect and remit them.
9. Payments, Payouts, and Refunds
Paying for washes. Where a facility accepts payment through the Services, the fleet authorizes us and our payment processor to charge its selected payment method for the wash price set by the facility, plus any applicable fees and taxes. A fleet organization is responsible for all charges made by its members.
Limited payment collection agent. Each facility that accepts payment through the Services appoints Tankerflow as its limited agent solely to accept payments from fleets on its behalf. A fleet's payment to Tankerflow satisfies the fleet's obligation to pay the facility for that wash. We will pay facilities the amounts collected for them, minus fees, refunds, chargebacks, and other amounts owed to us.
Stripe. Payment processing services for facilities are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to receive payouts through the Services, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of Tankerflow enabling payment processing services through Stripe, you agree to provide Tankerflow accurate and complete information about you and your business, and you authorize Tankerflow to share it and transaction information related to your use of the payment processing services provided by Stripe.
Payouts. Facilities must complete payout onboarding before receiving payouts. We may delay, withhold, or hold in reserve any payout, and may offset amounts you owe us against any payout, to address suspected fraud, disputes, refunds, chargebacks, legal requirements, or risk. We do not guarantee the timing of any payment, refund, or payout.
Refunds. If a booking paid through the Services is cancelled before the wash starts, the amount paid for the wash will be refunded, unless the Services showed a different cancellation policy when the booking was made. After a wash starts, refunds are between the fleet and the facility, but we may issue a refund or adjustment in our discretion. Platform fees are non-refundable, except where we decide otherwise or the law requires it.
Chargebacks. Facilities are responsible for refunds and chargebacks related to their washes. We may recover those amounts from the facility's payouts or charge them to the facility's payment method.
10. Receipts, Wash Certificates, and Wash Documents
The Services may generate receipts, wash certificates, and other wash documents from information provided by facilities, fleets, and the Services. Facilities are responsible for the accuracy of the wash details they record and for performing each wash to the standard stated.
When Tankerflow verifies a document, it confirms only that the document was issued through the Services and has not been changed. Verification does not confirm that a wash was performed, performed correctly, or meets any certification, regulation, industry standard, or customer requirement. Tankerflow does not issue certifications and does not guarantee that a facility holds any certification it lists.
When you choose recipients for your documents, you authorize us to send them. You are responsible for choosing the right recipients and for having the right to share the documents with them. Once a document is sent or shared, we cannot recall it. We may void or revoke any document that we believe was issued in error or through fraud.
11. Communications
You agree to receive communications from us electronically, including by email, text message, in-product notices, and postings on our website. Electronic communications satisfy any legal requirement that communications be in writing.
Text messages. By giving us a mobile number, you agree to receive text messages from Tankerflow about bookings, your account, and the Services, including messages sent with automated technology. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to marketing text messages is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle mobile information.
You can opt out of marketing emails as described in our Privacy Policy. You cannot opt out of service messages while you have an account.
12. Acceptable Use
You agree not to submit User Content or use the Services in a way that:
- Violates law, regulation, third-party rights, contractual obligations, or industry rules that apply to you.
- Is false, misleading, fraudulent, deceptive, defamatory, obscene, harassing, threatening, abusive, discriminatory, or otherwise harmful.
- Lists a facility, bay, service, price, or certification that is false or that you are not authorized to offer.
- Places bookings you do not intend to use, or holds slots to block other users.
- Infringes or misappropriates intellectual property, privacy, publicity, trade secret, or other rights.
- Contains malware, viruses, malicious code, or tools intended to damage, disrupt, or gain unauthorized access to systems or data.
- Attempts to obtain passwords, account credentials, payment information, or other sensitive information by phishing or deception.
- Sends spam, unauthorized advertising, or duplicative unsolicited messages.
- Interferes with another user's use of the Services.
- Involves unlawful hazardous materials, environmental, transportation, sanitation, or safety practices.
- Encourages or enables any of the above.
We may investigate suspected violations and may remove content, cancel bookings, suspend or terminate accounts, notify affected users or law enforcement, or take any other action we consider appropriate.
13. Feedback
If you provide ideas, suggestions, requests, comments, or other feedback about the Services, you grant Tankerflow the right to use that feedback for any purpose without restriction or compensation to you. Do not provide feedback that you consider confidential or proprietary.
14. Third-Party Services
The Services use, integrate with, and link to third-party products and services, such as sign-in, maps, routing, address search, payments, email, text messaging, hosting, analytics, and external websites. Third-party services are not controlled by Tankerflow, and your use of them may be subject to their own terms and privacy policies. Features that use Google Maps Platform are subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
We are not responsible for third-party services, third-party content, third-party websites, or the acts or omissions of any third party, including any fleet, wash facility, shipper, receiver, or other user.
15. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Services, you agree that we may process information as described in the Privacy Policy. You represent that you have given any notices and obtained any consents needed for us to process personal information that you or your organization submit about others, such as drivers, teammates, and document recipients.
16. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANKERFLOW AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT.
Tankerflow does not warrant that the Services will be uninterrupted, secure, error-free, accurate, complete, current, or available at any particular time or location.
Tankerflow does not warrant or guarantee any route, added driving time or distance, facility listing, facility availability, search ranking, booking outcome, wash quality, certification, receipt, wash certificate, document delivery, price, payment outcome, payout or refund timing, user conduct, or regulatory compliance. Features that use artificial intelligence may produce inaccurate or incomplete results, and you are responsible for reviewing them before relying on them.
You use the Services at your own discretion and risk.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANKERFLOW AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOST BUSINESS; LOST GOODWILL; LOST DATA; BUSINESS INTERRUPTION; CONTAMINATED OR REJECTED LOADS; DETENTION OR DELAY; SUBSTITUTE SERVICES; OR SIMILAR DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TANKERFLOW'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $50 OR (B) THE PLATFORM FEES YOU PAID DIRECTLY TO TANKERFLOW FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. AMOUNTS PAID FOR WASHES AND PASSED THROUGH TO FACILITIES ARE NOT FEES PAID TO TANKERFLOW.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
18. Indemnification
You agree to defend, indemnify, and hold harmless Tankerflow, its affiliates, and their respective officers, directors, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- Your access to or use of the Services.
- Your User Content.
- Your violation of these Terms.
- Your violation of law or third-party rights.
- Your facility, fleet, transportation, trailer, load, wash, environmental, safety, payment, tax, or other business operations.
- Any dispute between you and another user or third party.
We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense. You may not settle any indemnified claim without our prior written consent.
19. Dispute Resolution and Arbitration
You and Tankerflow agree to first try to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services ("Dispute") through good-faith informal discussions. A party starting a Dispute must send written notice to the other party. Notices to Tankerflow must be sent to support@tankerflow.com or to Tankerflow, LLC, 169 Madison Avenue, STE 42921, New York, New York 10016. The notice must include your name, telephone number, mailing address, the email address associated with your account if applicable, and a description of the Dispute.
If the Dispute is not resolved within 60 days after notice is received, either party may start binding arbitration as described in this Section. The Federal Arbitration Act governs this arbitration agreement.
Except for claims that may be brought in small claims court and claims seeking equitable relief for infringement or misuse of intellectual property rights, you and Tankerflow agree that Disputes will be resolved by binding individual arbitration administered by JAMS under its applicable rules. If JAMS is unavailable, the parties will select another arbitration provider. The arbitrator will decide all questions about the scope, enforceability, and validity of this arbitration agreement, except that a court will decide questions about the class action waiver and the batch arbitration provisions below.
YOU AND TANKERFLOW WAIVE ANY RIGHT TO A JURY TRIAL. YOU AND TANKERFLOW MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY CLASS, COLLECTIVE, REPRESENTATIVE, OR MASS ACTION. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except to the extent this limitation is not enforceable under applicable law.
If 100 or more substantially similar arbitration demands are filed against Tankerflow by or with the assistance of the same law firm, group of law firms, or organizations within a 30-day period, the demands may be administered in batches of up to 100 demands per batch, with one arbitrator per batch and one set of filing and administrative fees per side per batch, to the extent permitted by the arbitration provider's rules and applicable law.
You may opt out of this arbitration agreement by sending written notice of your decision to opt out to Tankerflow, LLC, 169 Madison Avenue, STE 42921, New York, New York 10016, or by email to support@tankerflow.com, within 30 days after you first become subject to this arbitration agreement. Your notice must include your name, mailing address, and a clear statement that you want to opt out of arbitration.
To the extent permitted by law, any Dispute must be brought within one year after the claim arises, or it is permanently barred.
These Terms and any Dispute are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any Dispute that is not subject to arbitration will be brought only in the state or federal courts located in New York County, New York, and you and Tankerflow consent to the jurisdiction of those courts.
20. Suspension and Termination
We may suspend or terminate your access to the Services, remove content, cancel bookings, restrict features, or close accounts at any time, for any reason or no reason, with or without notice.
You may stop using the Services at any time. Termination does not relieve you of obligations that accrued before termination, including payment, refund, chargeback, and indemnity obligations. After termination, we may keep and continue to use information as described in our Privacy Policy.
Sections that by their nature should survive termination will survive, including Sections 3, 4, 8, 9, 10, 13, and 15 through 24.
21. Copyright Complaints
Tankerflow respects intellectual property rights. If you believe content on the Services infringes your copyright, you may send a notice containing the following information:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing and information reasonably sufficient to help us locate it.
- Your address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
Copyright notices should be sent to Tankerflow, LLC, Attn: Copyright Agent, 169 Madison Avenue, STE 42921, New York, New York 10016, or to support@tankerflow.com.
22. Changes to These Terms
We may change these Terms at any time. When we do, we will post the updated Terms on this page and update the date above. If we consider a change material, we may also notify you by email or in the Services. Changes take effect when posted unless we say otherwise, and your continued use of the Services after that means you accept the updated Terms.
23. General Terms
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign these Terms without restriction.
You and Tankerflow are independent contractors. These Terms do not create a partnership, joint venture, employment, franchise, or agency relationship, except for the limited payment collection agency in Section 9. There are no third-party beneficiaries of these Terms.
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages of third-party services, network failures, natural disasters, and government action.
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
The word "including" means "including without limitation."
These Terms, together with our Privacy Policy and any additional terms that apply to particular features, are the entire agreement between you and Tankerflow regarding the Services.
